UGAO AGRITECH APPLICATION DISCLAIMER
Introduction
This Disclaimer (“Disclaimer”) governs the use of the Ugao Agritech mobile and web application (“Application”). By accessing or using the Application, you (“User”) acknowledge and agree to the terms and conditions set forth in this Disclaimer. If you do not agree with any part of this Disclaimer, you must discontinue use of the Application immediately.
Disclaimer of Liability
1. The Application is provided on an “as-is” and “as-available” basis, without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
2. Ugao Agritech does not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
3. Users assume all risks associated with the use of the Application, including but not limited to reliance on any data, recommendations, or services provided through the Application.
4. Ugao Agritech shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use the Application, including but not limited to damages for loss of profits, data, or business opportunities.
Indemnity Clause
1. The User agrees to indemnify, defend, and hold harmless Ugao Agritech, its affiliates, directors, officers, employees, agents, and licensors from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to:
a. The User’s use or misuse of the Application;
b. Violation of any applicable laws, regulations, or third-party rights;
c. Any breach of this Disclaimer by the User.
2. Ugao Agritech reserves the right to assume exclusive defense and control of any matter subject to indemnification, at the User’s expense, and the User agrees to cooperate fully in such defense.
Limitations of Warranties and Responsibilities
1. Ugao Agritech does not guarantee the accuracy, reliability, or completeness of any information, content, or services provided through the Application.
2. Users are solely responsible for verifying any agricultural, financial, or business decisions made based on the Application’s output.
3. Ugao Agritech shall not be responsible for any third-party content, services, or links accessed through the Application.
Governing Law and Dispute Resolution
1. This Disclaimer shall be governed by and construed in accordance with the laws of Pakistan.
2. Any disputes arising from or related to this Disclaimer shall be resolved through arbitration or mediation in Pakistan, unless otherwise required by law.
